Cancellation Policy

This Waiver and Release of Liability Agreement is entered into by Kelly McDonald, owner, operator, and instructor of CreaTe, and the undersigned participant (or parent/guardian if minor, i.e., participant). 1. Description of Activity The Participant voluntarily enrolls in art classes, workshops, or activities offered by CreaTe. These Activities may involve, but are not limited to: Use of sharp tools (e.g., scissors, knives, carving instruments). Handling art materials (e.g., paints, solvents, adhesives, clay, glass). Physical exertion (e.g., standing, bending, lifting). 2. Risk Identification The Participant acknowledges the inherent risks associated with the activities, including but not limited to: Injury from tools, materials, or accidents (e.g., cuts, burns, slips, falls). Allergic reactions or health complications from materials. Damage to or loss of personal property (e.g., broken items, theft, waste). Injury to others or property due to Participant’s actions. 3. Release of Liability The Participant waives all claims and agrees not to sue Create Art Studios, its owners, employees, or agents for: Bodily injury, illness, or death. Property damage, loss, or theft. Any other harm arising from participation in the Activities. 4. Indemnification The Participant agrees to defend, indemnify, and hold harmless CreaTe from any claims, lawsuits, or expenses (including legal fees) related to their participation, including claims by third parties. 5. Age Appropriateness The Participant confirms they meet the age requirement for the chosen class. Children Under 10: Parents/guardians of children aged 10 or younger must remain present at the studio during any participatory activity. If a child is left unattended, the parent/guardian assumes full liability for all damages or injuries caused by the child. 6. Damages and Losses The Participant accepts sole responsibility for: Damage to Studio property (e.g., tools, equipment, furniture). Loss or theft of personal belongings. Costs due to waste or misuse of materials. 7. Insurance Coverage The Participant acknowledges that Create Art Studios does not provide insurance covering personal injury or property damage. The Participant is responsible for securing their own insurance, if desired. 8. Acknowledgement of Under To cancel or reschedule, please do so within 24 hours of your chosen class. Not doing so disallow any refund. There are exceptions for emergencies - please reach out to Kelly with any issues or questions.
